Terms and Conditions

Welcome to Investionista.com. These Terms and Conditions govern your use of our website and services. By accessing or using our website, you agree to comply with and be bound by these terms. Please note that these terms may be subject to change. Your continued use of the Site or our programs following any updates constitutes your acceptance of the new terms.

 

1. Company Information:

Investionista.com (the “Site”) is owned and operated by Investionista LLC, a Wyoming limited liability company. This Agreement constitutes the complete and exclusive agreement between You and the Company regarding your use of the Site, as well as all associated programs, workshops, and coaching services.

 

2. User Eligibility:

You must be at least 18 years of age (or a legal adult in your jurisdiction) to book a program or purchase a workshop. By using this website, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

 

3. Investment & Earnings Disclaimer

Investionista LLC provides general education only. We are not registered investment advisors, broker-dealers, or financial planners.

Market Reality: You acknowledge that the stock market is inherently unpredictable. Investing in stocks, ETFs, and options involves substantial risk, including the possible loss of your initial investment (principal). No investment strategy can fully guarantee profits or eliminate the risk of loss in a fluctuating market.

Not Personalized Advice: Our programs, workshops, and content are designed to teach you a methodology for making your own decisions. Nothing provided by the Company constitutes personalized investment, tax, or legal advice. No fiduciary, advisory, or client relationship is created by your participation in any program, workshop, coaching session, or use of the Site.

Options Trading Risk: Some educational content may reference options strategies. Options involve unique risks, including time decay, leverage, assignment risk, and rapid loss of capital. Certain strategies can result in losses exceeding premiums paid. Options are not suitable for all investors. You are solely responsible for determining whether options trading is appropriate for your financial situation, experience level, and risk tolerance.

Historical Examples: We often use historical examples or student stories for educational purposes. Please understand that these are not typical and are not a guarantee that you will achieve the same results. Past performance does not predict future outcomes.

Financial Safety: You are solely responsible for your own investment decisions. We strongly believe in financial safety; you should only invest money that you have specifically set aside for long-term growth and that you can afford to lose without affecting your essential living expenses or lifestyle.

 

4. Service Delivery & Momentum

  • Group Sessions: To maintain the momentum of our community, group sessions occur at scheduled times. If you can’t make it live, a recording will be shared with the group so you don’t miss any insights. Access to the recording constitutes the successful delivery of that session.

  • Session Recordings: By participating in live sessions, you consent to being recorded for educational purposes. Recordings are made available only to enrolled participants and are considered part of the program delivery. 

  • 1-on-1 Sessions: We value your time and ours. 1-to-1 sessions may be rescheduled at no cost up to 24 hours before the start time. To respect the schedule, sessions cancelled with less than 24 hours’ notice (or “no-shows”) are considered used and are non-refundable.

      • Momentum & Completion: To help you achieve the best results, my programs are designed to be completed within 6 months. however, we understand that life happens. We provide a “grace window” of up to 9 months from your purchase date to complete all live components.

      • The 9-Month Boundary: After 9 months, our obligation to provide live, personal support or 1-on-1 sessions expires. While you may retain access to the pre-recorded video library, membership portal, and digital materials, any unused live sessions will be forfeited at this time. 

5. Communication & Reactivation Policy

Your success with this methodology depends on consistent momentum. To ensure that I can prioritize active students in my calendar, the following rules apply

Calendar Hold (After 45 Days): If you are in a program that includes 1-on-1 sessions and there is no communication or session attendance for 45 consecutive days, your personal support will be placed on a “Calendar Hold.” To reactivate your access and resume your sessions, a $250 Reactivation Fee may apply. This fee covers the administrative costs of re-allocating dedicated time for you in my schedule.

Termination due to “Ghosting” (After 90 Days): If 90 consecutive days pass without any communication or participation from your side, your right to personal support and 1-on-1 sessions is considered permanently forfeited. Your spot in the calendar will be released to other students, and the live portion of your program will be deemed completed.

Absolute Expiration Date: Regardless of your activity level, all rights to live support and 1-on-1 sessions expire exactly 9 months after your date of purchase, at which point the program is considered fully delivered.

6. Rights & Intellectual Property

Investionista LLC holds all rights to models, text, images, workshops, events, materials – printed and digital. As a participant, you receive access to a membership portal and materials; this access is personal and cannot be transferred. All products and materials may not be used commercially in direct or indirect competition with Investionista LLC’s business. Investionista LLC’s name and company name Investionista may not be used for advertising or referencing purposes without written permission.

  • Submissions: Any comments, suggestions, or ideas you provide to the Company (“Submissions”) are not confidential and shall become the sole property of Investionista LLC for unrestricted use without compensation to you.

  • User-Generated Content (Blog & Community): Comments on our blog or community areas are pre-moderated. We reserve the right to reject or remove comments that contain links, spam, or do not add value to the community. Once a comment is posted, it remains on the site unless you specifically request its removal.

  • Security: You are responsible for maintaining the confidentiality of your password. Investionista LLC is not responsible for any loss resulting from shared or compromised account access.

7. Refund Policy (RISE Method Workshop)

14-Day Satisfaction Guarantee: We want you to feel confident in your investment. You have a full right of rescission for 14 days from your date of purchase. This allows you to begin the program and attend your first live session. If you determine that the program is not the right fit for you within this window, you may cancel and receive a full refund.

  • Forfeiture of Guarantee: Your right to a refund and the 14-day guarantee expires immediately if any of the following occur:

    1. More than 14 days have passed since the date of purchase.

    2. You begin your second live session.

    3. You log into the member portal and access the restricted educational materials.

  • Binding Installment Plan: If you choose to pay in installments, your registration is legally binding for the full program fee once the 14-day guarantee period has expired (or has been forfeited as described above). Please note that an installment plan is a binding payment arrangement, not a subscription; all remaining installments must be paid on time regardless of whether you choose to complete the program.

  • Payment Default: In the event of late or missed payments, we reserve the right to suspend your access to both the member portal and live sessions until the balance is settled. Such suspension does not grant an extension of your overall 9-month program deadline.

 

8. Liability & Peace of Mind

We are committed to providing you with high-quality education, but it is important to establish where our responsibilities begin and end.

  • Responsibility: By using our Site, Programs and Services, you agree to protect and hold Investionista LLC and its team harmless from any legal claims or losses arising from your investment results or your use of our materials and guidance. Your financial journey is your own.

  • Commitment (Liability Cap): If a legal dispute were to arise, you agree that the Company’s total liability to you will never exceed the total amount you have actually paid for the specific service or product.

  • Emotional Well-Being: Our programs may involve discussions of risk, uncertainty, and long-term decision-making. We do not provide psychological, therapeutic, or emotional counseling services, and participation is not a substitute for professional mental health support.

  • Technology & Access: Our Site and portal are provided on an “as available” basis. We cannot be held responsible for temporary technical glitches, internet outages, or maintenance downtime beyond our control.

 

9. Testimonials & Results

Individual Experiences: Testimonials, case studies, and examples found on this Site are real-life experiences of individuals who have used our methodology. However, these results are not typical.

No Financial Tracking: We do not track the individual financial performance of our students and therefore cannot provide “typical” results or average returns. Your success is dependent on your own efforts, market conditions, and personal commitment. Investionista LLC does not guarantee that you will achieve any specific financial result or earn any money using our methodology.

 

10. Disputes & Governing Law

Governing Law: These terms and your use of the Site are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

Dispute Resolution: We believe most concerns can be resolved quickly through communication. However, if a dispute cannot be settled, you agree that any legal action shall beresolved through binding arbitration in Wyoming, administered under the rules of the American Arbitration Association (AAA).

Class Action Waiver: You agree to bring any claims against the Company only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

11. General Provisions

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. 

International Users: Investionista LLC operates from the United States. We make no representations that the Site or Services comply with the laws of jurisdictions outside the United States. You are responsible for ensuring that your participation complies with local laws and regulations applicable to you.

Entire Agreement: These Terms constitute the entire agreement between you and Investionista LLC regarding the use of the Site, as well as all associated programs, workshops, and coaching services.
